Standard Trading Terms

All services provided by WSLogistics are subject to these Standard Trading Terms unless otherwise agreed in writing. They limit our liability and create obligations for you, so please read them carefully. By instructing us to provide services, you accept these terms.
1. Definitions
“Company” means WSLogistics. “Customer” means the party engaging the Company. “Goods” means the cargo to which the services relate. “Services” means freight forwarding, customs, warehousing and related logistics services.
2. Application
These terms apply to every quotation and contract for services and prevail over any inconsistent terms proposed by the Customer.
3. Quotations and charges
- Quotations are valid for the period stated and may be revised for changes in rates, currency, fuel, duties or carrier surcharges.
- Online estimates are indicative only and not binding.
- Charges are payable within 14 days of invoice without set-off or deduction.
4. The Customer's warranties
- The Customer is authorised to deal with the Goods and the information provided is accurate and complete.
- Goods are properly described, packed, labelled and declared, including any dangerous goods.
5. Dangerous goods
Dangerous or hazardous goods must be declared in advance and comply with all applicable regulations. The Company may refuse, destroy or render harmless such goods without compensation where they pose a risk.
6. Liability
The Company acts as agent except where it expressly contracts as principal. To the extent permitted by law, the Company's liability for any claim is limited to the lesser of (a) the value of the affected Goods, or (b) 2 SDR (Special Drawing Rights) per kilogram of the gross weight of the affected Goods, and the Company is not liable for consequential or indirect loss. Any claim must be notified in writing within 14 days of delivery (or of the date the Goods should have been delivered), and any action must be commenced within 9 months.
7. Insurance
The Company does not arrange cargo insurance unless instructed in writing. We strongly recommend Customers arrange marine/transit insurance for the full value of their Goods.
8. Lien
The Company has a general and particular lien over the Goods and documents for all amounts owing by the Customer.
9. Governing law
These terms are governed by the laws of New South Wales, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
